By creating an account or using PickBits.AI ("PickBits", "we", "us", "our") — including the website, CyberHawk, Daily Signal, the PickBits SDK, and related account services — you agree to these Terms of Use, our Privacy Policy and our Refund Policy. Purchases made at PickBits Academy are covered by the same policies; earlier purchases remain covered by the terms in effect when they were made. If you do not agree, do not use the service.
What PickBits Provides
- Public work: use cases, CyberHawk security research, Daily Signal reporting, and information about projects and consulting.
- PickBits SDK: account, save, achievement, score, and related services used by connected PickBits products.
- Consulting inquiries: forms and scheduling links used to discuss potential work. A consulting engagement begins only when the parties agree to a separate scope and commercial terms.
- External destinations: PickBits Studio, PickBits Academy, Patreon, Steam, and social channels are separate services governed by their own terms.
The service may be temporarily unavailable for maintenance, updates, or unforeseen outages. We will make reasonable efforts to communicate planned downtime through the website or email.
Eligibility & Your Account
- You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.
- You may sign in with email + password, or with Google or GitHub OAuth via Supabase.
- You are responsible for all activity under your account, including keeping your password secure.
- You may only maintain one account per person. We may merge or close duplicate accounts.
Acceptable Use
You may:
- Use PickBits for personal learning, professional development, and the workflows it's designed to support.
- Use legacy paid content you purchased within your own work product without re-publishing the source material.
- Contribute to public PickBits open-source repositories under the licenses they're published with.
- Provide feedback to help us improve.
You may not:
- Resell, redistribute, sub-license, or post PickBits proprietary or legacy paid content to third parties or public locations.
- Share login credentials or rotate one paid account between multiple individuals.
- Scrape, mass-download, or programmatically harvest content beyond what a normal browser request would access.
- Attempt to gain unauthorised access to the service, its database, edge functions, or admin interfaces.
- Use bots, scripts, or automation to inflate XP, leaderboard scores, or arcade unlocks.
- Use the service for any illegal purpose, or to harass, defame, or harm others.
- Reverse-engineer, decompile, or create derivative works from PickBits proprietary content (open-source repos remain governed by their own licences).
AI-Generated Content Disclaimer
Patreon & Legacy Purchases
- Current Experimenters memberships are offered through Patreon. Payment, renewal, cancellation, membership benefits, and platform disputes are governed by the terms shown on the PickBits Patreon page and Patreon's own terms.
- Track Packs are sold at PickBits Academy, billed by Stripe under the same PickBits business. Those purchases, and Track Packs and subscriptions bought earlier on pickbits.ai, are governed by the terms presented at checkout and our Refund Policy.
- For help with a historical PickBits charge, entitlement, cancellation, or access issue, email owner@pickbits.ai.
XP, Levels & Arcade Rewards
- XP, levels, achievements, arcade unlocks, leaderboard positions, and flair badges have no monetary value.
- They cannot be sold, traded, or exchanged for real currency or other tangible goods.
- We may modify the progression system, retire arcade games, or adjust leaderboards at any time.
- Violation of these Terms may result in loss of accumulated progress.
Intellectual Property
The PickBits.AI brand, website design, copy, proprietary publications, software, and legacy paid materials are owned by PickBits and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the service and any paid content you previously purchased for personal or internal business use.
Open-source code published under the PickBits GitHub organisation is governed by the licence file in each repository (commonly MIT). Those terms supersede this section for that code.
You retain ownership of content you submit (profile information, contributed code, form responses, and feedback) and grant us a worldwide, royalty-free licence to use it solely to operate, improve, and promote the service.
Third-Party Services
The service relies on third-party providers (see our Privacy Policy for the full list). Their availability and terms can affect yours. We are not liable for outages or changes in third-party providers' services.
Disclaimer of Warranties
PickBits is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or available at all times, that the AI-generated content will be accurate, or that the service will meet your specific requirements.
Limitation of Liability
To the maximum extent permitted by law, PickBits and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of profits, data, or business opportunity. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater.
Account Termination
- You may delete your account at any time by emailing owner@pickbits.ai.
- We may suspend or terminate accounts that violate these Terms or that we have a reasonable basis to believe pose a security or legal risk.
- Upon deletion we remove your personal data per our Privacy Policy. Historical purchase records may be retained where legally required; voluntary deletion does not itself create a refund right.
Changes to Content & the Service
PickBits is a living, continuously updated set of publications and software. We may add, edit, correct, re-order, restrict, move, or retire content and features, including articles, security data, code samples, SDK capabilities, and connected products. We do this to keep material accurate, improve quality, comply with the law or third-party terms, or retire work that is outdated or no longer maintained.
Because of this, no specific piece of content is guaranteed to remain available, unchanged, or accessible at any particular URL indefinitely, even where you have paid for access to a track or subscription. If we materially remove or change premium content you have purchased, we will make reasonable efforts to provide an equivalent replacement or, where appropriate, a remedy under our Refund Policy. We are not obligated to retain, archive, or provide copies of content that has been updated or removed. By using PickBits, you accept that the service and its content will change over time and agree to these revisions. We recommend downloading or saving any material you wish to keep a personal copy of, as permitted under the Acceptable Use terms above.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the website or by email to your account address. Continued use after the effective date of updated Terms constitutes acceptance.
Governing Law
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona, unless otherwise required by mandatory consumer-protection law in your jurisdiction.
